Driver Supplemental Terms

These Driver Supplemental Terms ("Driver Terms") are intended to supplement the Terms of Use for Kango and apply to all Drivers authorized to use the Kango Services for the purpose of providing transportation services.

Remember that each Driver's use of Kango's Services is at all times subject to the Terms of Use (https://www.kangoapp.com/terms.html) which incorporates this Driver Supplemental Terms Policy. Any terms we use in these supplemental terms without defining them have the definitions given to them in the Terms of Use (https://www.kangoapp.com/terms.html) .

 

Driver Application

Users who wish to become a Driver must submit an application to Kango. We do not make any guarantees or commitments to individuals who want to become Drivers that they will become Drivers and we make decisions in this regard in our sole discretion. We reserve the right to perform background checks, including criminal and motor vehicle background checks, either ourselves or through third party service providers, to determine whether to grant an individual access to the Services as a Driver. As a condition of your use of our Services as a Driver, and where requested by Kango, you agree to provide any required or applicable signed consent to enable Kango or its third party service providers to conduct such background checks, and you agree to provide additional information in order to perform (or have a third party perform) such background checks. This additional information may include your social security number and DMV history. Individuals who wish to become Drivers must also attend any phone screenings, in-person interviews, and in-person trainings that Kango requires.

 

Representations and Warranties:

By using the Services, a Driver represents, warrants, and agrees that:

  1. The Driver is in the independent business of providing transportation services, and understands and intends to create the relationship of principal and independent contractor and not that of employer and employee between Driver and Kango.
  2. Driver is not an employee, agent, joint venturer, franchisee, affiliate, or partner of Kango for any purpose.
  3. The information provided by the Driver to Kango is true, accurate, and complete, and is not misleading.
  4. The Driver is at least 21 years of age.
  5. The Driver has at least 2 years of childcare experience.
  6. The Driver possesses a valid driver's license and is authorized to operate a motor vehicle and has all appropriate licenses, approvals and authority to provide transportation to third parties in all jurisdictions in which such Driver uses the Services.
  7. The Driver owns, or has the legal right to operate, the vehicle such Driver uses when providing transportation services, and such vehicle is clean, in good operating condition and meets the industry safety standards and all applicable statutory and state department of motor vehicle requirements for a vehicle of its kind.
  8. The Driver has had no more than had no more than three (3) points on their motor vehicle record during the past three (3) years for lesser driving offenses (such as equipment violations, speeding, or child safety seat violations), and has not, within the past seven (7) years, been convicted of reckless driving, driving under the influence of alcohol or drugs, hit and run, or driving with a suspended or revoked license.
  9. While Driver is authorized to use the Kango Services for the purpose of providing transportation services, Driver will immediately notify Kango if Driver is cited for or convicted of any offense that would make any of the foregoing statements untrue, including any moving violation, reckless driving offense, driving under the influence of alcohol or drugs, hit and run, or driving with a suspended or revoked license.
  10. The Driver has not, within the past seven (7) years, been convicted of: (a) driving under the influence of alcohol or drugs; (b) use of a motor vehicle to commit a felony; (c) fraud or a crime involving property damage and/or theft; (d) any sexual offense; (e) misdemeanor assault or battery; (f) a domestic violence offense; (g) any violent felony; or (h) any other felony offense or violation of the California Penal Code sections identified by Kango as disqualifying in its policies or disclosures.
  11. The Driver is not, and has never been, listed on the California Department of Justice Megan’s Law website or any other national or state sex offender registry, and is not currently required to register as a sex offender in any jurisdiction. The Driver will immediately notify Kango if the Driver is charged with or convicted of any of the offenses described in this Section or becomes subject to any sex‑offender registration requirement while authorized to use the Kango Services.
  12. The Driver is named or scheduled on the insurance policy covering the vehicle such Driver uses when providing transportation services.
  13. The Driver has a valid policy of liability insurance (in coverage amounts consistent with all applicable legal requirements) for the operation of such Driver's vehicle to cover any anticipated losses related to such Driver's provision of transportation services.
  14. The Driver will be solely responsible for any and all liability which results from or is alleged as a result of the operation of the vehicle such Driver uses to provide transportation, including, but not limited to personal injuries, death and property damages.
  15. In the event of a motor vehicle accident such Driver will be solely responsible for compliance with any applicable statutory or department of motor vehicles requirements, and for all necessary contacts with such Driver's insurance carrier.
  16. The Driver will obey all local laws related to the matters set forth herein, and will be solely responsible for any violations of such local laws.
  17. The Driver is medically fit to provide transportation services and to drive in accordance with applicable law.
  18. Driver will be solely responsible for the manner and hours in which Driver provides the transportation services.
  19. Driver shall not be eligible to participate in any of Kango's employee benefit plans, fringe benefit programs, group insurance arrangements or similar programs. Kango shall not provide workers' compensation, disability insurance, Social Security or unemployment compensation coverage or other employee-type statutory benefit to Driver, except to the extent required for “app-based drivers” under applicable law (for example, any occupational accident, disability, or similar coverage required by California Proposition 22 or any successor statute). 
  20. Driver does not have authority to enter into contracts that bind the Company or create obligations on the part of the Kango.
  21. Driver understands and agrees that Driver will have the sole discretion to determine the method, means and location of performing the transportation services and that Kango has no right to, and will not, control or determine the method, means or place of the performance of those services. Additionally, Driver will supply all tools and equipment necessary to perform such services, with the exception of child restraints such as car seats or booster seats, which may be provided by Kango if needed.

 

Zero Tolerance Policy

Kango maintains a zero tolerance policy regarding the use of alcohol, illegal substances, or the misuse of prescription medications. Kango also has zero tolerance for violating traffic laws and/or driving recklessly. Kango, in its sole discretion, reserves the right to terminate the account of any Driver violating its Zero Tolerance Policy.

 

Non Discrimination Policy

Driver agrees not to discriminate or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation. Driver will make reasonable accommodation for service animals.

 

Compliance with Kango Eligibility Standards. The Driver understands and agrees that Kango’s driver eligibility standards, including its background check, driving record, and zero-tolerance policies, may be more restrictive than applicable law, and that Kango may deny, suspend, or terminate the Driver’s access to the Services if Kango determines, in its sole discretion, that the Driver no longer meets those standards.

 

Fees, Payments; Collection and Remittance

Current rates for ride services are specified in the Fee Schedule. Kango reserves the right to change these rates at any time.

Kango collects fares and other amounts from Users for Paid Services performed by Drivers via the Services. Kango will, on behalf of each Driver, receive such amounts from Users and, after deducting the applicable service fees and other amounts described in Kango’s then‑current Service Fee Schedule (the “Service Fees”), will remit the remaining amounts to the Driver in accordance with these Driver Terms. Kango’s receipt of payment from a User for Paid Services is deemed payment to the Driver, and the Driver’s sole recourse for payment is against Kango as provided in these Driver Terms.

Before a Driver accepts a ride or other request for transportation services, Kango will generally display an estimate of the amount that Kango expects to remit to the Driver for completing that trip (the “Estimated Payout”). The Estimated Payout may take into account anticipated time, distance, applicable rates, and expected Service Fees. The actual amount ultimately remitted to the Driver for a completed trip may differ from the Estimated Payout based on factors such as the actual time and distance of the trip, tolls and surcharges, adjustments, discounts, taxes, chargebacks, refunds, or other amounts described in the Service Fee Schedule or Kango’s policies.

Subject to these Driver Terms and Kango’s then‑current payout practices, Kango will remit amounts owed to Drivers on a periodic basis (for example, weekly or monthly), in U.S. Dollars, to the payout account designated by the Driver. Kango may withhold, offset, or delay remittance of any amounts otherwise payable to a Driver if Kango believes it is necessary to do so to comply with applicable law or any order of a court or governmental authority, or to cover any actual or reasonably anticipated chargebacks, refunds, disputes, or other amounts the Driver owes to Kango.

Payment Processing

Payment processing for Drivers is provided by one or more third‑party payment processors. Currently, payment processing services for Drivers are provided by Stripe, Inc. (“Stripe”) and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”), as each may be updated by Stripe from time to time. By agreeing to these Driver Terms or continuing to use the Services as a Driver, you agree to be bound by the Stripe Services Agreement.

As a condition of Kango enabling payment processing services through Stripe, you agree to provide Kango with accurate and complete information about you (including any information Stripe requires to verify your identity and meet its legal obligations), and you authorize Kango to share that information and related transaction information with Stripe in connection with your use of the payment processing services. Kango is not responsible for any error by, or acts or omissions of, Stripe or any other payment processor.

Drivers shall be solely responsible for all costs and expenses incident to the provision of transportation services under these Driver Terms, including, but not limited to, the cost of fuel, the upkeep of the Driver's vehicle, and insurance premiums. In addition, Drivers shall bear and be responsible for any and all applicable federal, state, local, and foreign taxes, duties, tariffs, levies, withholdings, and similar assessments (including without limitation, sales, use, and value added taxes) relating to the subject matter hereunder, excluding taxes based on Kango's income.
